The employee handbook states that we will be paid double time if we work on a holiday. I work for an employer that requires us to work holidays. He pays us a holiday rate of time and a half. Does this holiday pay exempt him from counting that holiday in the normal workweek? Our employer says that since he pays us extra to work the holidays then that holiday is not included in the normal workweek. Is this legal?
